Welcome to Fifsee AI (the "Service"), operated by Fifsee Inc. ("Fifsee," "we," "us," or "our"), a Delaware-incorporated company. The Service includes our websites (fifsee.com, ai.fifsee.com, and equivalents), iOS and Android mobile applications, AI-powered real estate and travel intelligence tools, and all related features and content.

By accessing or using the Service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not access or use the Service.

1. Description of Service

Fifsee AI is a global, unified real estate and travel intelligence platform serving multiple user roles: Buyer, Seller, Tenant, Landlord, Host, Traveler, and Business. The platform operates across 118+ countries and is available on iOS, Android, and Web.

The Service is provided "AS IS" and evolves continuously. We may add, modify, or discontinue features at any time with or without notice.

2. Eligibility and User Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a legally binding contract to use the Service.

To access full features, you must create an account with accurate, complete, and current information. You are solely responsible for:

We reserve the right to suspend, limit, or terminate accounts at our sole discretion for any violation of these Terms, suspected fraudulent activity, or for any other reason we deem appropriate.

SSO Authentication: If you register via Google or Apple SSO, your access is also governed by Google's or Apple's respective terms of service. We are not responsible for changes to those services.

3. Token System and Access Tiers

Free Tier: Upon signup, users receive a one-time grant of 20,000 tokens. Tokens are consumed based on actual AI model usage (measured by Gemini token counts for inputs and outputs). The free grant does not reset.

Starter Plan: Provides 120,000 tokens upon payment. Tokens do not expire during your active subscription period.

Pro Plan: Provides 5,000,000 tokens upon payment. Tokens do not expire during your active subscription period.

Token Usage: Each AI feature interaction (report generation, chat messages, Market Insight queries, Get Connected requests) consumes tokens proportional to the complexity and length of the AI computation. Token balances are displayed in-app.

No Refunds for Consumed Tokens: Tokens consumed through legitimate use are non-refundable. If you believe tokens were consumed due to a platform error, contact support within 14 days.

5.1 Nature of AI Outputs

AI-generated reports, Market Insights, chat responses, Get Connected recommendations, and all other AI outputs are for informational and research purposes only. They do not constitute:

AI outputs are generated by large language models and may contain inaccuracies, outdated information, hallucinations, or errors. Market data is sourced from third-party providers and public data, which may not be current, complete, or accurate for your specific location or situation. Always verify AI outputs with qualified local professionals before making any real estate, financial, travel, or legal decision.

5.3 Deep Links and Third-Party Content

When the Service provides deep links or recommendations to third-party platforms, we are not responsible for the content, accuracy, availability, or practices of those platforms. Your use of third-party services is governed by their own terms.

5.4 Get Connected — Professional Referrals

AI-generated professional referrals (agents, attorneys, inspectors, etc.) are not endorsements. We do not verify the credentials, licensing, or quality of referred professionals. You are solely responsible for independently vetting any professional you engage through or because of the Service.

5.5 Visa and Travel Intelligence

The Traveler role provides general visa and entry information based on nationality and destination data. This information is not legal immigration advice and may not reflect current, jurisdiction-specific requirements. Always consult official government sources and qualified immigration professionals before travel.

5.6 AI Model Providers

The Service uses third-party AI engines (such as Google AI) and third-party search engine APIs for real-time search. Your queries and inputs may be processed by these providers subject to their own data handling practices. We take reasonable steps to minimize personal data sent to AI providers.

6. Intellectual Property

6.1 Our Property

All Fifsee AI content, trademarks (including the Fifsee name, logo, Bird mascot), AI models, report formats, platform architecture, software, and technology are the exclusive property of Fifsee Inc. or its licensors. Nothing in these Terms grants you any ownership rights.

6.2 Your Content

You retain ownership of content you upload (property details, profiles, images, documents). By uploading content, you grant Fifsee a worldwide, non-exclusive, royalty-free, sublicensable license to use, host, store, reproduce, modify (for formatting and AI processing), display, and distribute such content solely as necessary to provide the Service.

6.3 AI Output Ownership

AI-generated outputs (reports, insights, chat responses) are provided to you for personal, non-commercial use. You may not resell, republish, or commercially distribute AI outputs without written permission.

6.4 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.

7. Payments, Billing, and Stripe Integration

Payments are processed exclusively via Stripe, Inc. By making a purchase, you agree to Stripe's Terms of Service and the following:

8. FSBO Platform — Automatic Listing and Network Participation

By creating a Fifsee account, all users across all seven roles (Buyer, Seller, Tenant, Landlord, Host, Traveler, and Business) are automatically enrolled as participants in the Fifsee FSBO (For Sale By Owner) marketplace network. This enrollment enables core platform functions including mutual connections between users, AI-powered matchmaking, professional referrals via Get Connected, and the broader Fifsee real estate ecosystem.

8.1 What FSBO Network Participation Means

Participation in the FSBO network means your role, general location preferences, and publicly-shared profile information may be visible to other Fifsee users for the purpose of facilitating real estate connections. This includes:

8.2 FSBO Listings and Property Data

Users in Seller, Landlord, and Host roles may create FSBO property listings directly accessible to other Fifsee users. Buyers, Tenants, and Travelers may access these listings. All users are responsible for the accuracy of any listing or profile data they provide. Fifsee is not a licensed real estate broker and does not supervise, facilitate, or guarantee any transaction conducted between users.

8.3 How to Opt Out

If you do not wish to be listed or discoverable within the Fifsee FSBO network, you may delete your account at any time using the Delete Account feature available within the Fifsee iOS app (Settings → Account → Delete Account) or the Fifsee Android app (Settings → Account → Delete Account). Upon account deletion, your profile and listing data will be removed from the platform subject to the data retention periods described in our Privacy Policy.

Note: Partial opt-out (remaining a registered user while being excluded from the FSBO network) is not currently supported, as network participation is integral to the platform's core AI matching and connection functionality.

8.4 No Brokerage Relationship

Fifsee is a technology platform, not a licensed real estate broker, agent, or intermediary. We do not supervise, mediate, or guarantee any real estate transaction. FSBO transactions in many jurisdictions carry legal risks and may require licensed professional involvement. You are solely responsible for compliance with all applicable real estate laws in your jurisdiction.

9. Privacy

Your use of the Service is also governed by our Privacy Policy (below), incorporated herein by reference. By using the Service, you consent to our data practices as described therein.

10. Termination

We may terminate or suspend your access at any time, with or without cause or notice, at our sole discretion. Upon termination:

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Fifsee Inc. and its officers, directors, employees, contractors, agents, licensors, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles.

Disputes shall be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there.

Informal Resolution First: Before initiating legal proceedings, you agree to contact us and attempt good-faith resolution for at least 30 days.

Class Action Waiver: To the extent permitted by law, you waive any right to participate in class action lawsuits or class-wide arbitration against Fifsee.

EU/UK and Other Regions: Nothing in these Terms limits your rights under mandatory consumer protection laws in your jurisdiction, including EU consumer rights and GDPR protections.

15. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes via:

Continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree to changes, you must stop using the Service and delete your account.

17. End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you and Fifsee Inc., a Delaware corporation, governing your use of the Fifsee mobile application available on iOS and Android.

17.1 License Grant

Fifsee grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device you own, solely for personal, non-commercial use.

17.2 Auto-Renewable Subscriptions

The App offers the following auto-renewable subscription plans:

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period. Manage and cancel subscriptions through your App Store or Google Play account settings. No refund is provided for unused portions of a subscription period.

17.3 Consumable In-App Purchases

The App offers the following consumable in-app purchases:

All consumable purchases are final and non-refundable except as required by applicable law.

17.4 Restrictions

You agree not to copy, modify, distribute, reverse engineer, rent, sell, or sublicense the App, use it for any unlawful purpose, or remove any proprietary notices.

17.6 Termination

This EULA terminates automatically if you fail to comply with its terms. Upon termination, cease all use of the App and delete all copies.

17.7 Apple and Google - Third Party Beneficiaries

For iOS: Apple Inc. is a third-party beneficiary of this EULA. This EULA is between Fifsee and you only, not Apple. Apple has no obligation to provide maintenance or support.

For Android: Google LLC is not a party to this EULA and bears no responsibility for the App.

This EULA is governed by the laws of the State of Delaware, USA.
